Terms and
Conditions applicable to advertisers on the
French-Property-1st Website:
For the purpose of
these terms and conditions
the term "advertiser"
is taken to mean the agent / immobilier or any other
party wishing to place property / real estate
advertising on the French-Property-1ST
Web site.
the term "publisher"
is taken to mean First Select Property Ltd and the
web sites under the jurisdiction of First Select
Property Ltd, including, but not limited to,
www.french-property-1st.co.uk
and
www.first-select.org
the term
"advertisements" is taken to mean entry of property
descriptions and photographs on the
French-Property-1ST web site, and/or entries in the
Estate Agent Directory.

Advertisements
placed by the advertiser shall be legal, decent,
honest and truthful; shall comply with the
British Code of Advertising Practice and
relevant codes of the Advertising Standards
Authority. In placing advertisements the
advertiser warrants that advertisements comply
with the requirements of current legislation in
their home country.

The advertiser
represents and warrants that in placing
advertisements on the French-Property-1ST
website that it has the authority to do so,
notwithstanding that the advertiser may be
acting as an advertising agency or media buyer
or in some other representative capacity.

The Publisher
reserves the right to omit, suspend, or change
advertisements, where they are deemed not to
comply with applicable advertising codes, are
illegal, or otherwise unsuitable for the purpose
of the French-Property-1ST website.

The Publisher
reserves the right to make any alteration it
considers necessary or desirable in
advertisements and to require copy/text of the
advertisements to be amended by the advertiser
to meet approval.

The advertiser
agrees to indemnify the publisher in respect of
all costs, damages, or other charges falling
upon the publisher as the result of legal
actions or threatened legal actions arising from
the publication of the advertisements.

In no event will
the publisher be responsible in contract, tort,
negligence or otherwise, for: (a) loss of
profits, business, contracts, revenues,
goodwill, production and anticipated savings; or
(b) any indirect, consequential, special or
economic loss of any kind; arising from any
failure in the services offered by the
publisher.

The publisher
shall not be subject to any liability whatsoever
for failure to provide reference or access to
all or any part of the French-Property-1ST
website due to systems failures or other
technological failures of the publisher or the
Internet.

The advertiser
hereby grants to the publisher a world-wide,
non-exclusive, fully paid licence to reproduce
and display the advertisements, including all
contents, trademarks and brand features
contained therein.

The advertiser
agrees that it shall not assign, transfer or
resell any of its rights hereunder, except to
any of their affiliates.

Advertiser rates
are herein published as 'Marketing Fees'.
Marketing fees are current until otherwise
noted, and may be changed without notice by the
publisher.

Termination of
agreement: The advertiser may terminate this
agreement at any time. Termination or
cancellation of this agreement does not qualify
the advertiser to receive a refund.

Refunds: By
accepting this agreement the advertiser waives
their rights to refunds, no matter what the
nature of the request.

These Terms and
Conditions will be governed by and construed in
accordance with, the laws of England, and the
parties submit to the non-exclusive jurisdiction
of the English courts; and (ii) constitute the
complete and entire expression of the agreement
between the parties, and supersede all other
prior understandings, commitments, agreements
and (unless made fraudulently) representations,
whether written or oral between the parties.

Creation of an advertiser account constitutes
full and unequivocal acceptance of these terms
and conditions
